WELL THE GOOD NEWS IS THAT THE WATERLOO REGIONAL POLICE WEREN"T AT FAULT IN BOTH CHARTER VIOLATIONS CASES

The Waterloo Region Record two days ago carried the following story titled "Two court cases fall apart due to charter violations by police". The one involving the Waterloo Regional Police concerned an impaired driver who failed a roadside sobriety test. he was not advised of his right to legal counsel immediately after his arrest. The second case involved the Ontario Provincial Police who also failed to advise an arrested citizen immediately of his right to counsel.

I am of two minds on these cases as to where the blame totally falls. Were the police officers incompetent and or were they given poor training? Finally should our courts have let both individuals walk hence compounding the police errors? I am a very strong advocate of individual's rights under the Charter and other legislation thus I might lean towards the original police errors as the over riding fault exhibited. It is unfortunate if there is no legal remedy possible to both address the police errors as well as the legal fault of the individuals arrested.

  1. Judges seem to be agreeing with lawyers over police errors when it comes to human rights.Ive seen kitchener police ignore human rights .I've also seen young poor kids get found guilty for drinking and driving and on the same note I've also seen richer people beat the charge at a cost over $30.000.in lawyer fees even when guilty.Poor people don't have equal rights aswell as the money and time to fight charges .If you can't miss work cause financial can't afford to eat let alone pay a lawyer I know of several cases were the young adult just plede guilty cause could afford take time off work to fight rediculas charges mostly brought on by polices predujuce harassment totally ignoring citizens rights.kitchener famous for harrassing our youth and lower income people especially our handicapped who don't know they have human rights .I find one thing in common when rich people beat there drinking and driving charge after forking out $30.000 to the courts they never sue police for unlawful arrest. And they get to keep there job and lisence. But if you're poor you're lisence and job aswell as youre life's been destroyed cause the police love harrassing certain citizens.the proofs in the amount of times stopped by for police for no reason at all and the amount of rediculas charges when it's proof of harassment. Witch is proof people with disabilities don't have human rights when it comes to kitchener police and I'm sure other forces.Im sure in both cases of citizens beating there charges they payed lawyers and wasn't legal aid cases.strange or just the power of money

    1. Kitchener police shoot un armed hamilton man fleeing police .would be interesting to know if he was shot in back while running for his life on 401.and in Sudbury siu is also investigating another attempted murder by police in bus terminal 5 or 6 officer surround un armed citizen then open fire obviously tryn to kill him using deadly force instead of tazer or plain old fashion brute force witch was in the olden days used more then needed but now a days the use deadly force and try to con public into thinking was self defence or suicide by police as they say.But clearly the video shows attempted murder clearly opening fire using deadly force.obviously they were all incompatence or not trained in self defence or trained to take down a citizen seriously 6 against 1.and the lazy assess choose deadly force.Thankfully waz caught on cell or it would been another justifiable homocide.doubt any officers will be charged for attemtemted murder as clearly was same type incident as Toronto boy who was murdered by police on there bus
